Terms of Service — SnapShop

1. Acceptance; Parties

These Consumer Terms of Service ("Terms") govern your use of SnapShop's consumer app, websites, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. "SnapShop," "we," "us" means SnapShop AI LLC. "You" means the individual using the Service.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is not directed to children under 13, and you may not use the Service if you are prohibited from doing so under applicable law.

3. The Service; Our Role

SnapShop helps users identify products using photo, voice, text, or barcode inputs and may present purchasing and fulfillment options through participating retailers and partners. Product identification results are probabilistic and may be inaccurate. Unless explicitly stated otherwise, SnapShop is not the seller of record for products offered by third parties and does not manufacture, warrant, or guarantee products listed through the Service. Retailers and partners control pricing, availability, and their own refund/return policies.

4. Pilot/Beta Features; Changes

The Service or certain features may be offered as a pilot or beta. Features may change, be limited, or be discontinued at any time. Availability is not guaranteed.

5. Accounts and Security

If you create an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised.

6. User Content; License

"User Content" includes photos, images, text, voice inputs (and any transcripts), feedback, and other content you submit through the Service. You retain ownership of your User Content. You grant SnapShop and its service providers a non-exclusive, worldwide, royalty-free license to host, store, use, reproduce, modify, create derivative works from, and display User Content as necessary to operate, improve, and secure the Service, including for troubleshooting, product matching quality improvements, and safety/fraud prevention. This license continues for as long as we store your User Content, and for a reasonable period thereafter for backups and compliance purposes. You represent you have all rights necessary to submit User Content and that your User Content does not violate law or infringe the rights of others.

7. Acceptable Use

You agree not to: use the Service for unlawful, harmful, deceptive, or fraudulent purposes; upload content that infringes intellectual property or violates privacy rights; reverse engineer, scrape, or automate access to the Service without permission; interfere with or disrupt the Service or attempt to bypass security controls; abuse refunds, chargebacks, promotions, or other mechanisms in a fraudulent manner. We may suspend or terminate access for violations.

8. Third-Party Services and Link-Outs

Some features rely on third-party providers (including payment processors and couriers) and participating retailers. Their terms and privacy policies may apply. If the Service links you to third-party sites or apps, SnapShop does not control those third parties and is not responsible for their services.

9. Payments, Delivery, Refunds (High Level)

Payments, if offered through the Service, are processed by third-party payment processors. SnapShop is not a bank, card issuer, or payment processor. Delivery, if offered, is performed by third-party couriers and timing/quality are not guaranteed. Refunds and returns are generally governed by the retailer's policies and applicable law, though SnapShop may assist with support coordination.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service and users.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." SNAPSHOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SNAPSHOP DOES NOT WARRANT THAT PRODUCT IDENTIFICATION, PRICING, OR AVAILABILITY INFORMATION WILL BE ACCURATE OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPSHOP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPSHOP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You will indemnify and hold harmless SnapShop from claims arising out of your User Content, your misuse of the Service, or your violation of these Terms or applicable law.

14. Governing Law; Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in Clark County, Nevada.

15. Changes to These Terms

We may update these Terms from time to time. We will update the effective date when changes are made. Continued use of the Service after the effective date constitutes acceptance.
